A Durable Power of Attorney is a document that grants to another person (the “attorney-in-fact”) the right to execute and carry out certain activities on behalf of the maker. A typical Durable Power of Attorney will contain a laundry list of items that the attorney-in-fact may perform on behalf of the maker, including, but not limited to, collecting income, making withdrawals from account, suing, selling or purchasing assets, borrowing money or signing tax returns. In addition, a Medical Power of Attorney may be executed to grant another person the ability to make medical and health care decisions on one’s behalf, if one is incapacitated and unable to make such decisions on their own.
